REFERRAL PROGRAM TERMS

Earthly Body customers (“you”) may earn credit for use at https://shop.earthlybody.com by referring new customers to Earthly Body through our referral program (“Referral Program”). If you are an Earthly Body customer and choose to participate in the Referral Program, you must agree to these Terms, which become a part of the Earthly Body Referral Policy.

HOW TO PARTICIPATE IN THE REFERRAL PROGRAM

You will be assigned a personal referral link for referring customers by signing up with an email after checkout or in your account profile for registered users. To participate, you may refer friends who have not previously shopped at https://shop.earthlybody.com by sending them your personal referral link. Each new customer you refer who clicks on your personal referral link will receive a special discount for their first purchase at https://shop.earthlybody.com. Discounts are only valid for first time customers on their first purchase.

REDEEMING CREDITS

You will receive the amount specified at sign up after a referred customer has completed their first purchase. The credited amount will be sent to the email address used to sign up or can be found in the Account Profile for registered customers. It may take 24-48 hours after a referred customer has completed their purchase for credit to be sent. Referral credits are valid for one-time use through the end of the calendar year.

QUALIFYING FOR THE REFERRAL PROGRAM

To qualify for a Referral Program and to earn credit, the referred customer must be a new Earthly Body customer and must use a Referral Program link to make a first-time purchase.

SHARING REFERRAL LINKS

Referrals should only be used for personal and non-commercial purposes, and only shared with personal connections that will appreciate receiving these invitations. Referring customers may not collect referrals by:

– Self-referring by using multiple or false names, identities, accounts or email addresses.
– Referring anyone who is an existing customer, including an existing customer with an account under an alternate email address.
– Using spam or sending unsolicited emails to people they don’t personally know to collect referrals, or otherwise violating any applicable law, rule, regulation or third-party terms of use.
– Posting on message boards, internet advertisements, public forums, coupon sites or other online venues.
– Permitting another individual to use the referring customer’s account.
– Referring fake people to Earthly Body, impersonating another person, or otherwise providing Earthly Body with false or misleading information.
– Using the personal referral link in any manner that is disparaging or that otherwise portrays Earthly Body in a negative light.
– Any other restriction we impose on participants in our referral program in our discretion upon prior notice.

If Earthly Body determines in its sole discretion that there has been a violation of these Terms, Earthly Body reserves the right to cancel or rescind a referring customer’s credit, cancel the referred customer’s discounted order, and/or determine that one or both parties are ineligible to participate in this or future offers. Referring customers may also be liable for civil and/or criminal penalties under applicable law. Earthly Body reserves the right to void, verify or adjust credits at any time prior to or following posting and redemption.

YOUR RESPONSIBILITIES

By acquiring credits, you agree and acknowledge that we are granting you a limited, revocable license to a digital item and that the credit is not your personal property. Except as explicitly provided herein, your personal referral link and credits are non-transferable. You are responsible for keeping track of the credits in your account and notifying us of any discrepancies. Credit cannot be applied to previous purchases and is not redeemable for cash.

GENERAL

This Referral Program is subject to restriction, modification, suspension, or termination at any time upon notice to you in Earthly Body’s sole discretion. Earthly Body may suspend or terminate the Referral Program or your ability to participate in the Referral Program at any time for any reason. We may provide such notice in any way compliant with applicable law including via email to the last email address you provided to us, or by amending these Terms. All credits are voided immediately upon termination of our referral program. A referred friend may only use one referral link. If a referred friend receives referral links from multiple Earthly Body users, only the corresponding user of the referral link used for the first-time purchase and the corresponding promo code used by the referred friend will receive credit/discount. We reserve the right to suspend accounts or remove Credits if we notice any activity that we believe is abusive or fraudulent. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals as deemed fair and appropriate. We can update these Terms at any time without prior notice. Continued participation in the Referral Program after any modification shall constitute consent to such modification.
